Brewery news India: Tribunal upholds penalty imposed on Carlsberg, United Breweries for beer cartelisation
The National Company Law Appellate Tribunal (NCLAT) has upheld a ₹873 crore penalty imposed by the Competition Commission of India (CCI) on United Breweries Ltd, Carlsberg India and All India Breweries Association for cartelisation in beer making [Pawan Jagetia v CCI], the Bar and Bench reported on December 27.

Judicial Member Justice Rakesh Kumar and Technical Member Dr Ashok Kumar Mishra held that the appellant had, in their leniency application, already admitted to their involvement in the cartelisation.

“Once they have admitted their involvement in application filed under Section 46 read with Regulation 5, they were only entitled to question the imposition of penalty.”

Further, it was stated that in the case of cartelisation, the same could be inferred even from their conduct.

The issue arose when Crown Beers India and SABMiller India made an application alleging cartelisation against the appellants in relation to the production, marketing, distribution and sale of beer in India.

Thereafter, suo moto proceedings were initiated which culminated in the penalty being imposed.

The appellants before the NCLAT argued that the CCI’s order was liable to set aside since it found the appellants guilty only on the basis of their leniency application. It was contended that a leniency application was to be ...More info on site

Brewery news Australia: Great Northern crowned Australia’s favourite beer this year
Move over Carlton Dry, because Great Northern has officially been crowned Australia’s favourite beer this year, the LAD Bible reported on December 30.

According to data compiled by IRI Australia, the Queensland brew has been crowned number one on a top 10 list of best beers.

Great Northern just clipped Carlton Dry and XXXX Gold, which came in second and third place, respectively.

Coopers was placed fourth on the poll, while Victorian Bitter came in fifth place.

Corona, Tooheys, Asahi, Hahn and Pure Blonde also made it to the top 10 list.

However, many took to Facebook to weigh in on the poll, and reactions were divisive, to say the least.

One user wrote: “Looks like a list of varying degrees of potable urine. Onya Straya.”

Another said: “What about James Boag Or Cascade, lovely drop, the best!!!”

A third chimed in: “Glad to have contributed to Great Northern.”

However, some were quick to note that some brands of beer were foreign owned.

One user wrote: “Only one of those beer companies are Australian owned. How un Australian! Good ol Coopers. The only good beer on that list!!!!”

Another commented: “Only one Australian-owned brand there."

The truly Aussie beer included on the list was Coopers, which is still independent and Australian-owned.

Asahi, Carlton ...More info on site

Barley news Ukraine: Total grain harvest to be reduced three times in 2023
Problems with logistics and power supply during the export of agricultural products from Ukraine during the war make the cultivation of grain crops unprofitable, therefore, in 2023, the total harvest in the country will be reduced three times compared to the record pre-war level, to 40 million tonnes from almost 120 million tonnes, Interfax-Ukraine reported on December 27.

Reducing the harvest to such low rates is already inevitable due to the current economic situation in the country, but by financing the agricultural sector, Ukraine can achieve a crop growth of up to 70 million tonnes by 2024, Rafael Goroyan, owner of the Prometey grain trading holding, said in an interview with Interfax-Ukraine.

"Last year, 120 million tonnes of grain and oilseeds were harvested, this year they have already fallen to 60 million tonnes, and next year, according to my forecasts, there will be 40 million tonnes, that is, a drop of 300%! At the same time, the entire infrastructure of Ukraine is tailored for a harvest of 120 million tonnes and even more, this is what we have achieved in 30 years of independence. The entire infrastructure is designed for 120 million tonnes – cars, wagons, stations, ports, elevators – but there ...More info on site
