The Netherlands & Greece: Court orders Heineken to pay €111.2 million to Greek rival Macedonian Thrace Brewery
|
A Dutch court has ordered Heineken to pay €111.2 million (approximately $124.8 million) in damages and accumulated interest to Macedonian Thrace Brewery (MTB), the Greek brewer best known for its Vergina brand, after finding that the Dutch group's Greek subsidiary abused its dominant position in the country's beer market for more than a decade, BigGo Finance reported on October 21.
The ruling, issued Wednesday by the Amsterdam court, holds the parent company liable for the conduct of Athenian Brewery (AB), Greece's largest brewer. The court calculated that MTB lost out on €43.3 million (approximately $48.3 million) in profits over a 16-year period, and added €67.9 million (approximately $76.4 million) in interest because the anti-competitive behavior dates back to 1998.
The case follows a 2015 decision by Greece's competition authority, which fined Athenian Brewery €31.5 million (approximately $35.4 million) for thwarting rivals through exclusive agreements with retailers. Under those arrangements, outlets received discounts if they refrained from stocking competitors' beer, a practice the regulator said also pushed up prices across the market.
Heineken said it respects the legal process but will appeal the judgment, arguing it disagrees with the court on key points. "In our view, damage claims of this magnitude should be based

Australia: Final Tasmanian-brewed Boag's beers come off production line
|
The last Tasmanian-brewed Boag's beers were bottled in Launceston this morning, marking an end to 145 years of local production, ABC News reported on October 21.
In the past century and a half, Boag's has cemented itself as a state icon and often run ads about being brewed with clean Tasmanian water.
The final bottles exited the assembly line this afternoon, ahead of the brewery shutting its doors for the final time on November 6, taking with it 42 local jobs.
While the bottle production finished today, the final brewing day was in September.
Brewer Adrian Hinds, who has been a Boag's employee for 22 years, said it was an emotional day.
"To be honest, I'm holding it together; it's quite emotional," he said.
"Today was the last drop of Boag's put into containers; tanks are empty, everything's on a carton or pallet ready to go out to the public.
"Everyone was on the packaging line watching the bottles go through the labeller; it just shows what it means to the staff here.”
Mr Hinds said for the last mashing, "everyone came up, got a sample of grain, put it in the mash tuns, so everyone had that final little touch on the last brew of draught that

UK: Adnams studying outsourcing of beer production and packaging
|
Adnams is studying whether to move the brewing and packaging of its bottled and canned beers to an outside supplier as the Suffolk brewer tries to lower a logistics bill that now exceeds £300,000 a year, according to a report published on October 19 by The Grocer.
The review centers on Adnams’ small-pack beer business, meaning beer sold in bottles and cans. At present, those beers are brewed at the company’s site in Southwold and then transported to Carlsberg Britvic for packaging. The alternative now under review would place both brewing and packaging with another partner, removing the current need to ship beer from one site to another before it is packed for retail sale.
The Grocer reported that Adnams has held discussions with five possible partners as part of an internal project known as “Project Safe Harbour.” The talks raise the possibility that some of the brewer’s best-known beers, including Ghost Ship and Broadside, could in future be produced away from its long-established Southwold brewery. Adnams was founded in 1872 and has been based in the Suffolk coastal town for more than 150 years.
The reported review does not amount to an approved transfer of production. According to The Grocer, the project

South Korea: Craft beer slump drives pivots to highballs and wider sales channels
|
As the slump in Korea's craft beer market drags on, fortunes are diverging for companies that once led the craft beer boom. While firms that bulked up on beer alone during the boom are entering rehabilitation and bankruptcy proceedings one after another, those that diversified revenue sources with highballs and dining businesses are relatively holding up. Securing new growth engines beyond a craft beer–centric business model is emerging as the key to survival in the industry, Chosun.Biz reported on October 19.
According to the liquor industry on the 19th, Busan's first-generation craft beer company Wild Wave filed for bankruptcy with the Busan Bankruptcy Court in April and was declared bankrupt in June. It popularized sour (sour) beer in Korea and built a base of enthusiasts, but it could not withstand the accumulated losses from expanding its brewery and offline stores.
Amazing Brewing Company, which grew through collaboration beers such as "Jin Lager," was also declared bankrupt in April. It secured 18 billion won in investment and expanded convenience store distribution, but after entering corporate rehabilitation proceedings last year, it failed to find a buyer.
By contrast, companies that reshaped their business structures to match changing alcohol consumption are posting relatively solid results. Craft

France: 3% tax on alcohol advertising proposed in France
|
A French lawmaker has proposed a new 3% tax on alcohol advertising and public promotional events as part of France’s 2027 social security financing bill, a move that could raise marketing costs for major producers, importers, and distributors in one of Europe’s largest beverage markets, Vinetur reported on October 9.
The measure was filed Thursday in the National Assembly by Cyrille Isaac-Sibille, a member of the centrist Les Démocrates group, as an amendment to the draft budget bill for France’s social security system. The amendment is being examined in first reading by the Assembly’s Social Affairs Committee and is listed as still under review.
Under the text, the tax would apply to companies that produce, import, or distribute alcoholic drinks in France, or to their representatives, if their revenue in the last financial year was at least 10 million euros before value-added tax. The levy would be based on spending for the purchase of advertising space regardless of the type of medium or whether the format is physical or digital. It would also cover spending on public events and similar promotional activities.
The proposed rate is 3% of the pre-VAT amount of those expenses. Revenue from the tax would be assigned to France’s

Chile: Barriers still blocking beer sales in Chile’s bars despite antitrust settlement – AB InBev
|
Anheuser-Busch InBev says barriers still limit its ability to sell beer in Chile’s bars, restaurants and pubs, more than two years after a court-approved competition agreement was meant to open that market to rivals of local brewer CCU, Vinetur reported on October 19.
The claim was made by Juan Manuel Ferrés, the general manager of AB InBev Chile, in an interview published Monday by Diario Financiero. Ferrés said the company continues to see obstacles in the hospitality channel despite the 2024 settlement between Chile’s National Economic Prosecutor’s Office, known as the FNE, and CCU. “We still see the barriers,” he said, according to the newspaper.
His comments add a new complaint from a major competitor, but they do not amount to a new regulatory ruling or a formal finding that CCU has breached the agreement. The news is the public statement from AB InBev’s Chilean unit, not a new decision by Chilean competition authorities.
The issue centers on Chile’s on-premise beer market, the channel that includes bars, restaurants and pubs where customers drink on site. That segment was the focus of a conciliation agreement approved by Chile’s Competition Tribunal, or TDLC, on March 15, 2024. At the time, the FNE said CCU held

India: Tax officials probing Pernod, Diageo Scotch imports under India-UK trade pact
|
Indian tax officials are investigating whether liquor giants Pernod Ricard and Diageo wrongly classified some bulk Scotch imports, allowing them to pay lower tariffs introduced under the recently agreed India-UK trade pact, Reuters reported on October 19, citing five industry sources familiar with the matter.
Import tariff disputes have long been a sore point for foreign investors in India and embroiled companies like Samsung, LG and Volkswagen. They often involve large back-tax demands raised years after the items were imported, with Indian officials saying they are only enforcing the law.
Last week, tax inspectors made an unexpected visit to Pernod's India headquarters near New Delhi where they questioned company executives about their Scotch imports, three of the people said.
Diageo's Indian unit, United Spirits, in a stock exchange filing last week said its offices in multiple locations were searched on Friday as part of an "industry-wide exercise" by authorities, without saying what the search related to. The other two people said Diageo is also being investigated for how it classifies some Scotch imports.
Pernod told Reuters in a statement that it is cooperating with the Directorate of Revenue Intelligence and providing all information requested, adding it was committed to addressing any questions from the
